Area of application

1. Upon registration at community.create-your-style.com the participant agrees with the here mentioned terms of use and practise.
2. The participant agrees to contract the use of the services of create-your-style with D. Swarovski & Co., Swarovskistrasse 30, 6112 Wattens, Austria (“Swarovski”).
3. The use of the services of community.create-your-style.com is free of charge for the participant.
4. The participant can terminate the use of the offer of community.create-your-style.com at any time without giving any reason. On termination of the membership all data of the participant can be deleted upon request.
5. Swarovski can terminate the use of the participant at any time. This is in particular the case, when a participant states intentional or fraudulently information or intentionally breaks the terms of use or participation.

Participation rules

1. The following content examples cannot be published or circulated by community.create-your-style.com:
   Wrong facts, insults, swearwords or threats
   • Contributions that bother, offend, slander, threaten or denigrate other persons, ethnic groups or religious beliefs
   • Contributions with racist, violent, politically extremist, sexist, discriminating or other offensive content
   • Contributions with photos of naked persons or pornographic motives
   • Illustrations of physical or sexual violence
   • Photos of victims of acts of violence, war victims or natural catastrophes
   • The use of unconstitutional symbols or the illustration of power- glorifying motives or representations of war violence activities
   • Contributions intended for commercial use
2. In the case that the above obligations are violated, Swarovski reserves the right to block or delete the contribution and to exclude the author from any further use.
3. The participant may publish under the above-mentioned conditions only contents that he is entitled to do. He must not insert any links to prohibited other contents/sources (described as above). If publications contain references to third parties, they may be published only with the consent of the third party as well as under the above-mentioned conditions.
4. The participant cannot misuse non-approved data, store, edit, change, pass on, commercially use or misuse the data in any other form.

Liability of Swarovski

1. Swarovski does not take responsibility for information and data of third parties, in particular as to completeness, correctness, indemnity of third party rights or conformity with provisions or other obligatory rules.
2. The participants have the right to refer to or link other web sites in their contributions. Swarovski will not inspect or check these web sites. Swarovski is not responsible for the content, correctness or opinions represented on these web sites. Participants who refer to these web sites do so at their own risk.
3. Swarovski does not warrant the correctness, completeness or use of the information provided on community.create-your-style.com Swarovski is neither liable for the misuse of information published by the participants.
4. Swarovski does not warrant the effectiveness and operational state of the systems made available to the participant. Swarovski does not take responsibility for mistakes, omissions, interruptions, deletions, defects, delays in the use or transfer, failure of communication systems as well as unauthorized access or theft, destruction or changes of the information provided by the participant. Swarovski is not obliged to maintain existing information, data and services or interrupt or change them.
5. Swarovski does not accept responsibility for unauthorized knowledge obtained from personal user data through third parties or for statements and information that participants make available to third parties.
6. Swarovski is at any time entitled to withdraw in whole or part the services offered without giving any reason.

Duties of the participants

1. The participant is solely responsible for the content published by community.create-your-style.com. The participant is also solely responsible for all material in connection with/or information that it transmits to other participants as well as for its communication with other participants. Swarovski does not agree to this content and does not have any control of it. Swarovski cannot always check the content before take over by community.create-your-style.com. Swarovski can not give any assurance for contents or accuracy and reliability of contents, materials or information, which participants transmit to other participants.
2. The participant will indemnify Swarovski, its employees, partners, authorized trade representatives, persons with power of attorney or any other person acting in the name of Swarovski, whether an individual or legal entity, against any liability and obligations, expenditures and claims that result in damages based on insults, slander, violation of personality rights, loss of services for other participants, violation of immaterial rights or other rights. The indemnification refers also to costs that are necessary to defend such claims.

Copyright

1. Upon release of the contents on community.create-your-style.com: (Function “Share with the community”) the participant grants a license to Swarovski as well as the other participants on community.create-your-style.com that is transferable, non-exclusive, and not restricted in time or place. This right covers among other things also the right to edit, publish or circulate the contents of the participant. The license rights of Swarovski include commercial use; those of the participants are restricted to non-commercial use.
2. The participant declares and warrants that
   • it possesses the content published by it through community.create-your-style.com or is at least entitled to use it;
   • the publication of the content does not violate laws concerning data protection, exploitation, copyright, contract or other rights.

Final definitions

1. If a term of the license is or should be ineffective or if the contract should be incomplete, the remaining stipulations of the terms of use remain unchanged. The invalid and/or incomplete term is to be replaced by a term that effectively comes closest to the economically desired goal of the contract.
2. The choice of court is so far as legally permissibly Innsbruck (Austria). Austrian law governs the contract.
